Section 1Acceptance of This Policy
This Terms of Service, Refund, Cancellation, Chargeback & Shipping Policy ("Policy") governs your use of our website located at www.miamidadeapostille.com (the "Site") and all services provided by Miami Dade Apostille ("we," "us," or "our"), including but not limited to apostille processing, federal and state document authentication, notarization, VIN verification, fingerprinting, certified translation, and embassy or consular legalization support (collectively, the "Services"), as well as the shipment, mailing, and courier delivery of documents in connection with those Services.
By accessing our website, submitting a form, placing an order, submitting payment, delivering documents to us for processing, or providing a shipping address, the person or entity doing so ("Client," "you," or "your") acknowledges that they have read, understood, and agree to be bound by this Policy in its entirety. If you do not agree to this Policy, do not use our website or Services.
Part VII of this Policy (Privacy & Data Protection) sets out in full how we collect, use, and protect your personal information, including our SMS, email, cookie, biometric, and international data practices.
Section 2About Miami Dade Apostille
Miami Dade Apostille is an independent, privately owned document expediting service based in Miami, Florida, with locations at 2915 Biscayne Blvd, Suite 300-1, Miami, Florida 33137, and 10166 West Flagler Street, Miami, Florida 33174. We provide apostille processing, notarization, VIN verification, fingerprinting, certified translation, FBI background check processing, and related document authentication services to individuals and businesses.
We are not a government agency, court, embassy, or consulate, and we do not issue apostilles, certifications, background check results, or legal decisions ourselves. Our role is that of an expediter: we prepare, review, submit, and retrieve documents on the Client's behalf through the appropriate state, federal, or foreign authority, and we provide notarization, translation, fingerprinting coordination, and related services directly. Our fee compensates us for this expediting and processing work, not for the underlying government fee, agency decision, or third-party outcome.
Because the ultimate authentication, certification, or acceptance of a document rests with a Receiving Authority outside our control, Miami Dade Apostille cannot and does not guarantee that any Receiving Authority will accept a particular document, regardless of how it was prepared, translated, notarized, or authenticated. Miami Dade Apostille is not a forensic document examiner and processes documents, including for apostille and authentication, on the reasonable presumption that they are genuine; see Section 45 (Document Authenticity & Fraud Disclaimer) for the complete policy on this point.
Section 3Definitions
"Order" means any request for Services submitted with payment, whether placed online, by phone, by email, or in person.
"Work Has Begun" means Miami Dade Apostille has taken any affirmative step toward fulfilling an Order, including but not limited to reviewing a submitted document, contacting a government agency or consulate, beginning a translation, scheduling a notary appointment, or preparing paperwork for submission. Work Has Begun is deemed to occur no later than the moment the Client's payment is successfully charged, since Miami Dade Apostille, as an expediting service, typically begins order review and processing immediately upon payment, often before any human follow-up communication is sent.
"Receiving Authority" means the government agency, consulate, embassy, court, financial institution, employer, school, or other third party to which the Client ultimately intends to submit the processed document.
"Chargeback" means a reversal of a card or electronic payment initiated by the Client's bank or card issuer, as opposed to a refund processed directly by Miami Dade Apostille.
"Rush" or "Expedited" Service means any Order for which the Client has paid an additional fee for accelerated processing.
"Carrier" means any independent third-party shipping or courier company used to transport a document, including but not limited to FedEx, UPS, the United States Postal Service (USPS), DHL, or a local courier service.
"Original Document" means a physical document that is not readily reissuable by its source, or that can only be reissued through a delay-prone or costly process — for example, an apostilled document, a certified vital record, or a notarized original.
"Reissuable Document" means a document that the Client or a government office can readily obtain another certified copy of without significant delay or cost.
"Tracking Confirmation" means the Carrier's tracking record showing scan events for a shipment, including pickup, transit, and delivery.
Section 4Services Offered
Miami Dade Apostille provides the following professional document services:
Apostille Processing: Authentication of documents for international use in countries that are members of the Hague Apostille Convention, including state-level and federal-level apostilles.
FBI Apostille: Processing of FBI Identity History Summary (background check) documents for apostille certification at the federal level.
Notarization: Notary public services for documents requiring a notarial act under Florida law.
VIN Verification: Vehicle identification number verification services performed by a Florida notary public, typically for out-of-state vehicles being titled or registered in Florida.
Fingerprinting: Electronic fingerprinting services for FBI background checks, employment, licensing, and immigration purposes.
Certified Translation: Professional document translation services that meet apostille and international legal requirements, available in multiple languages.
Embassy / Consular Legalization: Authentication services for countries that are not members of the Hague Convention, requiring embassy or consulate legalization.
Document Retrieval: Assistance in obtaining vital records, certified copies, and official documents from government agencies.
DNA Testing: Coordination of DNA testing and sample collection services, including for immigration, legal, or personal purposes, through a third-party laboratory partner.
Service availability, processing times, and fees are subject to change. Current pricing and turnaround times are provided upon inquiry or at the time of order.
Section 5Eligibility
You must be at least 18 years of age to use our website or order our Services. By using our Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
Section 6Permitted Use of Our Website
You may use our website for lawful purposes only. You agree not to:
- Use the Site in any way that violates applicable local, state, federal, or international law or regulation;
- Submit false, misleading, or fraudulent information through any form or contact method;
- Attempt to gain unauthorized access to any portion of our website or systems;
- Use automated tools, bots, or scrapers to extract content from our website;
- Transmit any viruses, malware, or other harmful code through our website;
- Impersonate any person or entity, or misrepresent your identity or affiliation;
- Use our website to harass, abuse, or harm any individual or entity.
Website Accessibility
Miami Dade Apostille is committed to providing a website that is accessible to all users, including individuals with disabilities, and we work toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA, on an ongoing basis. If you experience difficulty accessing any part of our website or require assistance in an alternative format, please contact us using the information in Section 80, and we will make reasonable efforts to assist you promptly.
Section 7Intellectual Property
All content on our website, including but not limited to text, graphics, logos, images, and software, is the property of Miami Dade Apostille or its content suppliers and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our website content without our express written permission.
Orders, Payment & Client Responsibilities
Section 8Order Submission
Orders for our Services may be placed by visiting our office in person, submitting a request through our website contact form, calling us at 1-800-631-9171, or emailing [email protected]. An order is considered accepted when we provide you with a written or verbal confirmation and receive the required documents and payment.
Section 9Payment Authorization
Payment is required at the time of order or as otherwise agreed. We accept major credit cards, debit cards, and other payment methods as displayed at the time of checkout. All payments are processed securely through our third-party payment processor. We do not store full credit card numbers on our servers.
By providing payment information, the Client represents and warrants that:
- They are the authorized holder of the payment method, or have the express authority of the account holder to use it for this transaction;
- The payment information provided is accurate and current;
- They authorize Miami Dade Apostille to charge the full amount of the Order, including any applicable rush fees, shipping fees, translation fees, notarization fees, and third-party filing fees disclosed at the time of the Order; and
- They will not seek to reverse, dispute, or charge back a payment for Services actually rendered in accordance with this Policy, except through the good-faith resolution process described in Section 27.
Work on an Order begins the moment the Client's payment method is successfully charged. As an expediting service, we typically begin reviewing the submitted document, confirming the correct process, and preparing the Order for submission immediately upon payment, often within minutes and before any human follow-up communication is sent to the Client. Absent a specific written confirmation from us that an Order has not yet started, the Client should assume Work Has Begun as of the moment of successful payment.
Section 10Document Requirements
You are responsible for providing accurate, complete, and authentic documents for processing. Miami Dade Apostille is not responsible for:
- Delays caused by incomplete, incorrect, or inauthentic documents;
- Government agency rejections due to document defects not within our control;
- Documents that do not meet the requirements of the destination country or authority;
- Processing delays caused by government agency backlogs, holidays, or closures;
- Delays caused by illegible files, or by password-protected or encrypted electronic files submitted without our prior approval and the access information needed to open them.
If documents are rejected by a government authority for reasons outside our control, we will notify you promptly. Additional fees may apply to resubmit or correct documents.
Section 11Client Responsibilities
You agree to:
- Provide accurate and complete information when placing your order;
- Submit original or properly certified documents as required for the service;
- Respond promptly to our requests for additional information or documentation;
- Ensure your contact information (phone, email, address) is current and accurate;
- Maintain copies of all documents submitted to us for processing, since Miami Dade Apostille does not retain document copies once a completed document has been delivered to you (see our Privacy Policy).
You are responsible for confirming, in advance, the specific document requirements of the Receiving Authority, including whether an apostille, authentication, or consular legalization is required; whether a certified translation is required; document age or validity restrictions; and any formatting requirements. Miami Dade Apostille can advise on general processes based on our experience, but the Client remains responsible for final confirmation with the Receiving Authority. This is especially important given that, as set out in Section 23, all sales are final.
Section 12Fees
Fees for our Services are provided at the time of order and are subject to change without notice. All fees are quoted in U.S. dollars. Government fees, courier fees, and other third-party costs are separate from our service fees and are the client's responsibility unless otherwise stated.
Section 13Processing Times, Turnaround & Factors Outside Our Control
Miami Dade Apostille does not guarantee specific turnaround times for apostille or government agency processing unless explicitly stated in a written service agreement. Estimated processing times provided at the time of order are based on typical government processing speeds and are subject to change. We offer expedited processing options for an additional fee, subject to availability.
We are not responsible for delays caused by factors entirely outside our control, including but not limited to:
- Government office closures, staffing shortages, backlogs, or processing changes at any state, federal, or foreign authority;
- Postal service or Carrier delays, loss, or damage in transit;
- Consulate or embassy scheduling, holidays, or policy changes;
- Weather events, natural disasters, civil unrest, or other force majeure events;
- Incomplete, inaccurate, or delayed information or documents provided by the Client;
- Technology outages affecting government submission portals or payment processors.
Miami Dade Apostille shall not be liable for, and no refund shall be due on account of, any delay or failure to perform caused in whole or in part by any of the foregoing factors. If your order is delayed beyond a reasonable time, we will communicate the delay to you promptly and work to resolve it as efficiently as possible. Shipping-specific delay provisions are addressed in Section 35.
SMS / Text Messaging Terms
Section 14SMS Program Description
This Part III constitutes the official SMS Terms of Service for Miami Dade Apostille and governs all text message communications between our business and our clients.
Miami Dade Apostille operates an SMS messaging program to communicate with clients regarding appointment confirmations, document order status, pickup notifications, and general customer service inquiries related to our professional document services.
SMS messages are sent from our registered business number: (786) 528-8470. This SMS program, and our text messaging practices generally, are designed to comply with the federal Telephone Consumer Protection Act (TCPA), which requires prior express consent before certain automated or marketing text messages are sent to a mobile number and requires that opt-out requests be honored promptly.
Section 15How to Opt In
You may opt in to receive SMS messages from Miami Dade Apostille by:
- Providing your mobile phone number on our website contact or appointment form and checking the SMS consent checkbox;
- Verbally consenting to receive SMS messages when calling our office;
- Texting our business number to initiate communication.
By opting in, you confirm that you are the account holder or have the account holder's permission for the mobile number provided, and that you consent to receive automated and manually sent text messages from Miami Dade Apostille.
Section 16Consent Is Not a Condition of Purchase
You are not required to consent to receive SMS messages as a condition of purchasing any service from Miami Dade Apostille. You may fully use all of our Services without opting in to SMS communications.
Section 17Message Frequency
Message frequency varies depending on the status of your order or appointment. You may receive up to 5 SMS messages per order or appointment. We do not send unsolicited promotional or marketing text messages, and consenting to these operational messages does not enroll you in any separate marketing text program. If we ever introduce a promotional SMS or WhatsApp program, enrollment will require separate, affirmative consent, clearly distinguished from consent to operational messages.
Section 18Message and Data Rates
Standard message and data rates may apply to all SMS messages sent and received. Rates are determined by your mobile carrier. Miami Dade Apostille does not charge additional fees for SMS messages.
Section 19How to Opt Out (STOP)
You may cancel your SMS subscription and opt out of all future SMS messages at any time by replying STOP to any text message received from Miami Dade Apostille. After receiving your STOP request, we will send you a final one-time confirmation message, and you will no longer receive SMS messages from us.
You may also opt out by emailing [email protected] with subject line "SMS Opt-Out" and your phone number, or by calling 1-800-631-9171 and requesting to be removed from SMS communications. Opting out of SMS messages does not affect your ability to receive services or communicate with us by phone or email.

Section 21Supported Carriers
Our SMS program is supported by all major U.S. mobile carriers including AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, Metro PCS, and others. Carrier availability may vary. Carriers are not liable for delayed or undelivered messages.
Section 22No Sharing of Phone Numbers or SMS Consent Data
Miami Dade Apostille does not sell, rent, lease, or share your mobile phone number with any third party for their marketing or promotional purposes. Your phone number is used solely for the business communications described in this Policy.
Mobile information, including your phone number and your SMS opt-in status, is not shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are never shared with any third party for any purpose. We may share your phone number only with the specific third-party service providers described in Section 53 who help us deliver text messages on our behalf (such as our SMS messaging platform provider), and solely for that purpose.
Refunds, Cancellations & Chargebacks
Section 23All Sales Are Final
All sales are final. Due to the personalized, time-sensitive, and often irreversible nature of our Services — many of which involve immediate preparation, review, and coordination with a third-party government agency, consulate, or translator — Miami Dade Apostille does not issue refunds under any circumstances once payment has been submitted and an Order has been accepted, except as expressly set out in Section 26 (Discretionary Exceptions).
This no-refund policy applies regardless of whether Work Has Begun at the time a refund is requested, and consistent with Section 9, work is deemed to begin at the moment of successful payment. Without limiting the foregoing, no refund will be issued for any of the following:
- Client errors, including incorrect, incomplete, expired, or illegible documents submitted for processing;
- Delays caused by a Receiving Authority, Carrier, postal service, or any third party outside our direct control;
- Missed deadlines resulting from the Client's late, incomplete, or delayed submission of documents or information;
- Rejection of a document by a Receiving Authority for reasons unrelated to an error by Miami Dade Apostille, including changes in that authority's requirements;
- The Client's change of mind, change in circumstances, or decision that the Service is no longer needed, at any point after the Order is placed;
- Government filing fees, courier fees, or other third-party costs already incurred or paid out on the Client's behalf, whether or not the underlying Service is later cancelled;
- Cancellation of an Order for any reason, including before Work Has Begun.
Section 24Service-Specific Refund Terms
Apostille & Authentication Processing
All apostille and authentication Orders are non-refundable from the time payment is accepted, regardless of whether the document has yet been submitted to a Secretary of State's office, the U.S. Department of State, or any other authenticating authority, and regardless of the outcome of that submission.
Notarization, VIN Verification & Mobile Notary Services
Notarization and VIN verification fees are non-refundable once an Order is placed. Mobile notary travel fees are non-refundable once a notary has been scheduled or dispatched, regardless of whether the signing is ultimately completed.
Certified Translation
Translation Services are non-refundable from the time payment is accepted. Because a translation is a custom work product created specifically for the Client's document, it has no resale value, and Miami Dade Apostille reserves translator time and resources upon acceptance of the Order regardless of subsequent cancellation.
Document Legalization & Embassy/Consular Support
All embassy and consular legalization Orders are non-refundable once accepted. Embassy and consular fees are set by the foreign government in question, are non-refundable by that government in most cases, and are therefore non-refundable by Miami Dade Apostille as well.
Fingerprinting Services
Fingerprinting session fees are non-refundable once an appointment is scheduled, regardless of whether the resulting fingerprint card or LiveScan submission is later accepted by the requesting agency.
Rush & Expedited Fees
Rush and expedited service fees are non-refundable once the Order has been placed.
Section 25Cancellation Policy
A Client may request cancellation of an Order at any time by contacting us in writing at [email protected] or by phone at 1-800-631-9171. Consistent with Section 23 (All Sales Are Final), cancellation of an Order — for any reason and at any point after payment is accepted, including before Work Has Begun — does not entitle the Client to a refund. Miami Dade Apostille will stop further processing on a cancelled Order upon request, but fees already paid are retained in full.
Section 26Discretionary Exceptions
Notwithstanding Sections 23 through 25, Miami Dade Apostille may, at its sole and absolute discretion, grant a rare exception to this no-refund Policy on a case-by-case basis, including a partial or full refund, credit toward future Services, or waiver of a fee. No Client is entitled to such an exception, and none should be expected or requested as a matter of course. Any exception that is granted is extended solely as a courtesy, does not waive any provision of this Policy for that Client's future Orders or for any other Client, and may be conditioned on payment of an administrative fee to cover processing, documentation, and staff time already expended.
Section 27Good-Faith Dispute Resolution
If the Client has a concern about an Order, the quality of Services rendered, a shipment, or a charge on their account, the Client agrees to first contact Miami Dade Apostille directly at [email protected] or 1-800-631-9171 and provide us a reasonable opportunity — no less than five (5) business days — to investigate and respond before initiating a chargeback, dispute, or other reversal of payment with a bank, card issuer, or payment processor.
Miami Dade Apostille will make good-faith efforts to resolve any legitimate concern raised in this manner, which may include, at our discretion, correcting an error, completing incomplete work, assisting with a Carrier claim, or issuing a refund or credit consistent with this Policy.
Section 28Chargebacks & Payment Disputes
Nothing in this Policy is intended to discourage a Client from exercising their legitimate right to dispute a charge with their bank or card issuer where fraud, an unauthorized transaction, or a good-faith billing error has genuinely occurred. This Policy addresses only chargebacks filed against a legitimate, authorized transaction for Services that were actually rendered in accordance with the Client's Order and this Policy.
A chargeback filed for Services that were properly rendered — for example, because the Client changed their mind, a Receiving Authority ultimately declined the document for reasons unrelated to our processing, or the Client simply did not read this Policy before ordering — is not a legitimate basis for a chargeback and will be contested by Miami Dade Apostille as described in Section 29.
Section 29Consequences of Unauthorized Chargebacks
Where a Client initiates a chargeback for Services that were properly rendered in accordance with the Client's Order and this Policy, without first pursuing the good-faith resolution process in Section 27, Miami Dade Apostille reserves the right to:
- Compile and submit documentary evidence to the card issuer or payment processor, including order records, correspondence, proof of document submission or delivery, and this Policy, to contest the chargeback through the applicable card network's standard dispute process;
- Pursue recovery of amounts legitimately owed through Florida small claims court or county court, as appropriate based on the amount in controversy;
- Seek recovery of documented administrative costs, collection costs, and, where permitted by the underlying agreement and applicable law, reasonable attorney's fees actually incurred in connection with contesting an unauthorized chargeback or pursuing collection, in an amount supported by contemporaneous records rather than a predetermined flat fee;
- Decline to accept future Orders from the Client, consistent with our general right to refuse service.
Note on fees: Any administrative or collection cost sought in connection with a disputed chargeback will be based on actual, documented costs rather than an arbitrary flat amount, consistent with applicable law governing liquidated damages and card network rules, which generally prohibit penalizing a cardholder simply for exercising their dispute rights.
Shipping & Courier
Section 30In-Person Pickup Is the Expected Method
Once a document is completed, the Client is expected to pick it up in person, or arrange for an authorized representative to do so, at the applicable Miami Dade Apostille location during posted business hours. In-person pickup is the default method contemplated by our Services and avoids all shipping-related risk. Miami Dade Apostille will notify the Client when a completed document is ready for pickup.
Section 31Shipping Is Optional and At the Client's Own Risk
If a Client chooses not to pick up a completed document in person and instead requests that it be shipped, that choice is made entirely at the Client's own election and risk. Miami Dade Apostille is not a shipping or delivery company. When we ship a document at a Client's request, we act solely as the shipper tendering the package to an independent third-party Carrier. Once a package is scanned into a Carrier's possession, that Carrier — not Miami Dade Apostille — has physical custody and control of the document, and that Carrier's own terms of service, tariffs, and liability limitations govern the shipment exclusively.
Miami Dade Apostille is not responsible for a shipment once it is tendered to the Carrier. By requesting shipment instead of in-person pickup, the Client accepts all risk of loss, delay, or damage in transit, and agrees that any claim regarding that shipment must be pursued directly against the Carrier, not against Miami Dade Apostille, as set out in Section 35.
Section 32Carriers Used for Client-Requested Shipping
Where a Client requests shipping in lieu of pickup, we may use any of the following Carriers, among others, at our discretion unless the Client specifies otherwise:
DOMESTIC
FedEx, UPS, USPS (including Priority Mail and Priority Mail Express)
INTERNATIONAL
FedEx International, UPS International, USPS International, DHL Express
LOCAL
Local courier services for same-day Miami-Dade, Broward, and Palm Beach delivery
Selecting a Carrier or service level does not change the allocation of risk described in Section 31 — the Client bears that risk once the package is tendered to the Carrier regardless of which Carrier or service level is used.
Section 33Client-Provided Labels, Carrier Accounts & Label Reimbursement
If the Client provides their own prepaid shipping label or requests that a package be shipped using the Client's own Carrier account, Miami Dade Apostille's responsibility is limited to tendering the package to the Carrier in accordance with the label or account instructions provided. We are not responsible for insurance coverage, service level, or delivery guarantees associated with a Client-provided label or account, as those terms are established between the Client and the Carrier directly.
Where the Client instead asks Miami Dade Apostille to purchase the shipping label on the Client's behalf, we may front the Carrier's cost for that label and charge the Client the equivalent amount. This charge is a direct reimbursement of the actual cost Miami Dade Apostille paid to the Carrier for that specific label, not a sale of a shipping product or service by Miami Dade Apostille to the Client, and is not marked up as a revenue item. All Carrier-related risk, terms, and liability limitations described in this Part V apply in full to a label purchased and reimbursed under this Section, exactly as they would to a label the Client purchased directly.
Section 34Signature Confirmation & Insurance Are the Client's Decision
If the Client elects shipping over in-person pickup, the Client is solely responsible for deciding whether to request signature-required delivery and whether to purchase additional declared-value insurance through the Carrier. Standard Carrier shipments include only the Carrier's own limited default liability coverage, which in most cases does not reflect the true cost, time, or difficulty of replacing an apostilled or notarized Original Document. Miami Dade Apostille may make signature-required or insured service available upon request and pass through any associated Carrier fee, but does not select a service level on the Client's behalf and does not default to a higher level of protection unless the Client specifically requests it.
If the Client does not request signature confirmation or additional insurance, the Client acknowledges and accepts that delivery may be made to an unattended location and that any Carrier claim for a lost or damaged package will be limited to the Carrier's modest default liability amount.
Section 35Lost, Damaged, or Delayed Packages — Client Files Directly With the Carrier
Once a package has been tendered to a Carrier and a Tracking Confirmation has been issued, all responsibility for the physical safety and timely delivery of that package rests exclusively with the Carrier under the Carrier's own terms of service. Miami Dade Apostille is not an insurer of the shipment, does not guarantee delivery timeframes provided by a Carrier, and is not responsible for a package once it has been tendered to the Carrier.
If a package the Client elected to ship is lost, significantly delayed, or arrives damaged, the Client — not Miami Dade Apostille — is responsible for filing and pursuing any claim directly with the Carrier. Upon request, Miami Dade Apostille will provide documentation reasonably available to us, such as proof of shipment and Tracking Confirmation, to assist the Client in filing that claim, but we do not file claims on the Client's behalf and are not a party to the claim.
Where a Reissuable Document is lost in shipment, the Client is responsible for requesting a replacement from the issuing authority, at the Client's own expense. Where an Original Document that required apostille, authentication, or consular processing is lost in shipment, any reprocessing, including new government or authentication fees, is the Client's sole responsibility; Miami Dade Apostille's original service fee remains non-refundable in all cases, consistent with Section 23.
Practical note: Because Carrier claims and reissuance of government documents both take time, a lost original apostilled document is genuinely one of the more difficult things to recover quickly. This is the primary reason in-person pickup is our recommended and expected method for completed documents, and why we encourage Clients who do choose to ship to seriously consider signature-required delivery and additional declared-value insurance.
Section 36Original vs. Reissuable Documents
Miami Dade Apostille may, as a courtesy, note whether a given document is an Original Document or a Reissuable Document when a Client elects to ship rather than pick up. This information is provided for the Client's awareness only. The final decision on whether to ship at all, and if so at what service level, rests entirely with the Client, as does all resulting risk under Sections 31 and 35.
Section 37International Shipments
International shipments are subject to additional risk and delay factors outside our control, including customs processing, foreign postal system handling, import restrictions, and, in some destination countries, materially less reliable delivery infrastructure than is typical in the United States. Miami Dade Apostille is not responsible for customs delays, customs holds, import duties, or delivery failures caused by the destination country's postal or customs system. International Clients who elect shipping over pickup are strongly encouraged to select a trackable, signature-required service with declared-value insurance, and are solely responsible for any claim arising from an international shipment, consistent with Section 35.
Section 38Address Accuracy
The Client is solely responsible for providing a complete and accurate shipping address, including apartment or suite number, correct postal code, and any delivery instructions required by the destination. Miami Dade Apostille is not responsible for delivery failure, delay, or loss resulting from an incomplete, outdated, or inaccurate address provided by the Client. Reshipment to a corrected address is available at the Client's expense.
Section 39In-Person Pickup & Drop-Off
Clients pick up or drop off documents in person at either of our Miami locations during posted business hours. This is the expected and recommended method for both submitting documents to us and receiving completed documents back, and it is the only method that avoids the shipping risk described in this Part V entirely. Documents handed to Miami Dade Apostille staff in person, or picked up in person by the Client or the Client's authorized representative with valid identification, are not subject to the Carrier-related provisions of this Part V.
Section 40Client Responsibilities If Shipping Is Chosen
A Client who elects shipping instead of in-person pickup agrees to:
- Understand and accept that Miami Dade Apostille bears no responsibility for the shipment once it is tendered to the Carrier;
- Confirm the shipping address is complete, current, and correct;
- Independently decide on, and request, an appropriate service level (standard, signature-required, or insured) based on the value and replaceability of the document being shipped;
- Be available to receive and sign for delivery where signature-required service has been selected;
- File any claim for a lost, delayed, or damaged package directly with the Carrier, promptly and within that Carrier's claim window, as described in Section 35.
Section 41Claims Are the Client's Responsibility
The Client, not Miami Dade Apostille, is responsible for filing and pursuing any Carrier claim for a lost, delayed, or damaged package. Upon written request, Miami Dade Apostille will provide documentation reasonably available to us, such as proof of shipment, Tracking Confirmation, and a general description of the package contents, to assist the Client in filing that claim directly with the Carrier. Miami Dade Apostille does not file claims on the Client's behalf, is not a party to any Carrier claim, and has no obligation regarding the outcome, timing, or amount of any claim, which are determined solely by the Carrier.
Service-Specific Policies & Disclaimers
Section 42Notary Public Services & Identity Verification
Our notaries public perform notarial acts in accordance with the law of the state in which the notarization occurs, most commonly Florida. A core part of that act is identity verification: the notary confirms the signer's identity using satisfactory evidence of identity as defined by applicable state law, which typically means a current government-issued photo identification document, a credible identifying witness, or the notary's personal knowledge of the signer.
Notaries public are not forensic document examiners and are neither trained nor legally required to detect sophisticated forgeries. If a signer presents identification that is fraudulent, forged, stolen, or otherwise fraudulently obtained, but that reasonably appears genuine on its face to a notary exercising ordinary care, Miami Dade Apostille is not responsible for that fraud, and the resulting notarization remains a valid notarial act as to the notary's own performance of their duties. The signer, by presenting identification and signing before the notary, represents and warrants that the identification presented is genuine and that they are in fact the person they claim to be. This warranty runs in favor of Miami Dade Apostille, and a signer who breaches it is subject to Section 73 (Indemnification).
The notary's certificate confirms that the signer appeared, was identified in accordance with law, and signed or acknowledged the document; it does not confirm the truthfulness of the document's contents, the signer's legal capacity or authority beyond what is legally required for the notarial act, or the signer's motives.
Section 43VIN Verification Services
Florida notaries public are authorized under Florida law to verify a vehicle identification number (VIN) and certify that verification for submission to the Florida Department of Highway Safety and Motor Vehicles, most commonly in connection with titling or registering an out-of-state vehicle in Florida.
Our VIN verification confirms that the VIN physically observed on the vehicle at the time of inspection matches the VIN appearing on the title, manufacturer's statement of origin, or other paperwork presented to us. This is a visual, point-in-time comparison, not a forensic or law-enforcement-grade examination. We do not have specialized tools, training, or database access to detect sophisticated VIN tampering, re-stamped or altered VIN plates, cloned VINs, or other concealment techniques that are not apparent on ordinary visual inspection, and we do not run law enforcement or National Motor Vehicle Title Information System (NMVTIS) database checks as part of a standard VIN verification unless separately engaged to do so.
Miami Dade Apostille is not responsible if a vehicle's VIN has been altered, tampered with, cloned, or otherwise fraudulently represented in a manner not reasonably detectable through standard visual inspection. The Client is solely responsible for independently verifying vehicle history and title integrity, including through NMVTIS or a similar vehicle history service, before purchasing or registering a vehicle.
Section 44Certified Translation Policy
Our certified translations are prepared by qualified translators and are certified as accurate and complete translations of the source document presented to us, to the best of the translator's professional ability. This certification attests to the linguistic accuracy and completeness of the translation as against the source document; it does not attest to, and should not be understood as verifying, the authenticity, legality, or truthfulness of the underlying source document itself.
We translate the source document as presented. We do not independently verify that a source document is genuine, unaltered, or legally valid before translating it, and Miami Dade Apostille is not responsible if a source document later proves to be fraudulent, forged, or altered, consistent with Section 45. Where portions of a source document are illegible, ambiguous, or missing, our translation will note this rather than guess at the content.
Requirements for translations vary by Receiving Authority and by country — some require a "certified" translation, others a "sworn" or notarized translation, and formatting expectations differ. The Client is responsible for confirming with the Receiving Authority which type of translation is required before ordering.
Section 45Document Authenticity & Fraud Disclaimer
This Section applies across all of our Services, including apostille and authentication processing, notarization, VIN verification, certified translation, fingerprinting, and embassy or consular legalization support. By submitting a document to Miami Dade Apostille, the Client represents and warrants that the document is genuine, authentic, and lawfully obtained, and that the Client has the legal right to submit it for processing.
Miami Dade Apostille is not a forensic document examiner, law enforcement agency, or government verification authority. We process documents based on the reasonable presumption that a document presented to us is genuine, and we are not equipped or obligated to independently authenticate the underlying document, its signatures, seals, or the records it reflects beyond what is apparent on its face through ordinary review. If a document we have processed is later determined to have been fraudulent, forged, altered, or fraudulently obtained, and we had no actual knowledge of that fact at the time of processing, Miami Dade Apostille bears no liability for the fraud or its consequences, and the Client remains solely responsible for any resulting harm. This is consistent with, and does not limit, the indemnification the Client owes us under Section 73.
If Miami Dade Apostille has actual knowledge or a reasonable, good-faith suspicion that a document is fraudulent, we reserve the right to decline or discontinue processing that document and, where we believe the law requires or permits it, to report the matter to the appropriate law enforcement or regulatory authority.
Privacy & Data Protection
Section 46Documents You Send Us
To provide our Services, we routinely receive copies or originals of highly personal documents, which may include passports, driver's licenses and other government-issued identification, birth certificates, marriage and death certificates, divorce decrees, FBI Identity History Summary (background check) reports, state background checks, diplomas and transcripts, powers of attorney, corporate documents, and other documents you submit for apostille, notarization, translation, or legalization.
We receive these documents because you have asked us to process them on your behalf — to prepare, notarize, translate, submit for apostille or authentication, or legalize them for use with a Receiving Authority. We do not request or accept documents from you for any purpose unrelated to the Services you have ordered.
Section 47Categories of Personal Information We Collect

Section 48Sensitive Documents: Passports, IDs & Vital Records
We treat passports, government-issued identification, vital records, and similar sensitive documents with heightened care. Access to these documents is limited to the staff members directly involved in processing your specific Order, and to the third-party service providers described in Section 53 who need the document to complete a discrete step in that process (for example, a courier transporting the physical document, or a translator preparing a certified translation).
We do not use the content of your sensitive documents for any purpose other than fulfilling your Order, and we do not use identifying information from your documents for marketing or profiling purposes.
Section 49Biometric Data (Fingerprinting)
If you order fingerprinting or LiveScan Services, we collect your fingerprint images for the sole purpose of completing that service and transmitting the resulting fingerprint card or electronic submission to the government agency, employer, licensing body, or other requesting party you have designated. We do not sell, lease, trade, or otherwise profit from biometric data, and we do not disclose fingerprint data to any party other than the requesting agency or body you have designated, except as required by law.
We collect only the minimum biometric information necessary to complete the fingerprinting service requested, and we do not use fingerprint data for identification, profiling, or any purpose beyond the specific submission you have authorized.
State Biometric Privacy Laws
Several states have enacted biometric privacy statutes that impose notice, consent, and retention-schedule requirements on any business that collects fingerprint or other biometric data, regardless of that business's size or revenue. These include, among others:
- Illinois — the Biometric Information Privacy Act (BIPA), which requires written notice and consent before collection, a publicly available retention schedule, and permits affected individuals to bring a private lawsuit for violations;
- Texas — the Capture or Use of Biometric Identifier Act (CUBI), which requires consent before capture and reasonable care in storage and transmission, enforced by the Texas Attorney General;
- Washington — H.B. 1493, which requires notice and consent before enrolling biometric identifiers in a database for a commercial purpose, enforced by the Washington Attorney General.
If you are located in, or the fingerprinting service relates to a resident of, a state with a biometric privacy statute, we will provide any additional notice or obtain any additional consent required by that state's law before collecting your biometric data, and we will retain and destroy that data consistent with the schedule required by that law.
Florida Fingerprinting: FDLE & the FBI
For fingerprinting services performed in Florida, submissions are routed through the Florida Department of Law Enforcement (FDLE), which processes Livescan electronic fingerprint submissions and, where applicable, forwards them to the Federal Bureau of Investigation (FBI) for a national criminal history check. Miami Dade Apostille is not FDLE and does not make decisions about how FDLE, the FBI, or any other agency uses, stores, or discloses your fingerprint submission once it reaches that agency's systems; FDLE's and the FBI's own privacy and retention practices govern data once it is in their custody. We only facilitate the capture and transmission of your fingerprints as an independent Livescan service provider or expediter, consistent with Section 70 (No Government Affiliation).
Consistent with Florida law and FDLE requirements, our fingerprinting operations are subject to the following:
- FDLE registration: Under Section 943.053(13), Florida Statutes, any vendor, entity, or agency that electronically submits fingerprints for a criminal history record check must operate under a User Agreement with FDLE. Miami Dade Apostille maintains its own User Agreement with FDLE and, for certain submissions, also submits through a partner entity's User Agreement and assigned Originating Agency Identification (ORI) number. In either case, the applicable agreement governs quality compliance standards, fee handling, treatment of an applicant's personally identifiable information, and audit practices.
- FBI-certified equipment: Livescan devices used to capture and transmit fingerprints must appear on the FBI's Certified Products List for Livescan systems.
- Results are not sent to us: Fingerprint-based criminal history record check results are transmitted by FDLE to the requesting agency, employer, or licensing body associated with the relevant ORI — not to Miami Dade Apostille and not to you directly. We facilitate the capture and submission of your fingerprints; we do not receive or store your background check results.
- Personnel security screening: Employees and contractors with access to fingerprint data or any criminal justice information that may pass through our systems undergo their own fingerprint-based background check before being granted that access, consistent with the personnel security requirements of the FBI's CJIS Security Policy.
- Required applicant disclosures: Before submitting your fingerprints for a criminal history record check, we provide the privacy and record-challenge disclosures required by FDLE and the FBI, including information about how your fingerprint-based record may be shared and retained and your right to challenge an inaccurate criminal history record, and we obtain your signed, dated acknowledgment of those disclosures.
Biometric Consent, Release & Withdrawal
By scheduling and paying for fingerprinting or other biometric Services, you consent to the collection, use, and transmission of your biometric identifiers as described in this Section, for the sole purposes of identity verification, background checks, and transmission to the government agency, employer, licensing body, or other requesting party you have designated — including, where applicable, FDLE, the FBI, the Agency for Health Care Administration (AHCA), or U.S. Citizenship and Immigration Services (USCIS).
You acknowledge that once your biometric data is transmitted to a requesting agency, Miami Dade Apostille has no control over that agency's own processing timeline, decisions, or any delay or error in that agency's handling of your submission, and you release Miami Dade Apostille from liability for delays or errors caused by the requesting agency, consistent with Section 46 (Limitation of Liability).
You may withdraw your consent to biometric data collection at any time before the biometric Service has been rendered by notifying us in writing at [email protected]. You understand and agree that withdrawing consent before a scheduled fingerprinting or biometric appointment has occurred may prevent us from completing the Service you requested, and that this Policy's no-refund provisions in Part IV apply to any fees already paid at the time of withdrawal.
Note: Biometric privacy laws vary significantly by state and carry meaningful compliance obligations independent of business size. This section reflects our general practice; our CJIS-related procedures and both FDLE agreement arrangements described above should be reviewed periodically by a licensed attorney to ensure this description remains accurate and compliant as FDLE and FBI requirements are updated.
Section 50Why We Collect & Process This Information
We collect and process personal information for the following purposes:
- To provide the apostille, notarization, fingerprinting, translation, or legalization Service you have ordered;
- To communicate with you about your Order, including status updates, requests for additional documents, and delivery confirmations;
- To process payment for Services rendered;
- To comply with legal, regulatory, and record-keeping obligations applicable to notarial acts and document processing;
- To maintain the security and integrity of our website and Services;
- To improve our Services and website based on aggregated, and where possible de-identified, usage information.
Section 51Our Staff Access
Access to your documents and personal information within Miami Dade Apostille is limited to employees and contractors who need that access to process your specific Order — for example, the notary handling your signing, the translator assigned to your document, or the staff member preparing your submission to a government agency. We do not grant blanket access to client documents across our organization.
Employees and contractors with access to client documents and personal information undergo a background check as part of our hiring process, given the sensitive nature of the documents we handle.
Section 52Government & Receiving Authorities
To complete your Order, we necessarily submit your documents and related information to the government agency, consulate, embassy, or other Receiving Authority you have designated — for example, a state Secretary of State's office, the U.S. Department of State, the FBI, or a foreign consulate. These authorities process the information in accordance with their own laws and privacy practices, which are outside our control. Submitting your document to the designated Receiving Authority is the core purpose of our Service and is necessary to complete your Order.
Section 53Third-Party Service Providers
We work with the following categories of third-party service providers, each of which receives only the information necessary to perform its specific function on our behalf:

We require our service providers to handle your information in a manner consistent with this Policy and only for the purposes for which we have engaged them. We do not authorize these providers to use your information for their own independent marketing purposes.
Section 54International Transfers
Because some of our Services involve certified translation, international shipping, or coordination with offices and partners outside the United States, your information may be transferred to, stored in, or processed in countries other than the United States. Where this occurs, we take reasonable steps to ensure the receiving party protects your information consistently with this Policy.
Section 55We Do Not Sell Your Information
Miami Dade Apostille does not sell, rent, lease, or trade your personal information, document contents, or phone number to third parties for their own marketing or advertising purposes.
Section 56Retention & Deletion
We retain copies of your documents only for as long as your Order is in progress — from submission through completion and delivery. Once a completed document has been picked up in person or shipped to the Client, we do not keep a copy of that document. This applies whether the document was returned by in-person pickup or by shipment; we do not retain document files or scans on our systems after the completed document has left our possession.
This document-deletion practice is separate from our notarial journal, which Florida law requires notaries public to maintain. The notarial journal records the fact that a notarization occurred — such as the date, the type of notarial act, and the identification used to verify the signer — and is retained in accordance with Florida notary recordkeeping requirements; it does not consist of a retained copy of the underlying document itself.
We may also retain limited Order information not derived from the document itself — such as your name, contact information, and payment and communication records — for as long as reasonably necessary to respond to follow-up questions, comply with other applicable recordkeeping obligations, and defend against potential legal claims. You may request deletion of this information as described in Section 68, subject to these legal and recordkeeping limitations.
Section 57Data Security Practices
We maintain administrative, technical, and physical safeguards designed to protect your personal information and documents against unauthorized access, disclosure, alteration, or destruction. These safeguards include background-checked staff, restricting document access to employees and contractors with a legitimate need, using reputable third-party processors for payment and cloud storage, and maintaining physical security at our office locations.
Consistent with standard security practice, we do not publish the specific technical details of our security measures, as doing so could itself create a security risk. No method of transmission or storage is completely secure, and we cannot guarantee absolute security of your information.
Section 58Data Breach Notification
In the event of a data breach involving your personal information, Miami Dade Apostille will comply with applicable notification requirements under Florida law, including the Florida Information Protection Act, which generally requires notification to affected Florida residents and, where applicable, the Florida Attorney General, following discovery of a breach involving certain categories of personal information. Notification timing and content will follow the requirements of that law and any other applicable law based on your location.
Section 59Email Communications & Marketing
We may send you transactional emails related to your Order, such as confirmations, status updates, and receipts, which are necessary to provide the Services you have requested and are not subject to opt-out in the same way marketing email is.
If we send promotional or marketing emails, each such email will comply with the CAN-SPAM Act, including by:
- Using accurate, non-deceptive sender information and subject lines that reflect the content of the message;
- Identifying the message as an advertisement where required;
- Including our valid physical postal address;
- Providing a clear and conspicuous opt-out mechanism in every marketing email; and
- Honoring opt-out requests within the timeframe required by law, and in no event later than 10 business days.
You may unsubscribe from marketing emails at any time using the link provided in the email, or by contacting us using the information in Section 80.
Section 60What Are Cookies
Cookies are small text files placed on your device by a website you visit. They allow a website to recognize your device, remember certain information about your visit, and, in some cases, help the website or a third party understand how visitors use the site. This Part explains what cookies www.miamidadeapostille.com (the "Site") uses and why.

Section 62Google Analytics
Our Site uses Google Analytics, a web analytics service provided by Google LLC, to help us understand how visitors interact with our Site. Google Analytics uses cookies to collect information such as the pages you visit, how long you spend on the Site, the website that referred you to us, your general geographic location (typically city or region level, not a precise address), and general information about the device and browser you are using.
This information is collected in aggregate and is used to help us understand Site usage patterns and improve our content, navigation, and services. Google Analytics data is processed by Google in accordance with Google's own privacy policy, available at policies.google.com/privacy. We do not use Google Analytics data to personally identify individual visitors, and we do not combine Google Analytics data with the personal information you provide to us when you place an Order.
Opting out of Google Analytics specifically: You can prevent your data from being used by Google Analytics across all websites by installing the Google Analytics Opt-out Browser Add-on, available at tools.google.com/dlpage/gaoptout.
Section 63Cookies We Do Not Currently Use
As of the date of this Policy, our Site does not use advertising cookies, social media tracking pixels (such as a Meta/Facebook Pixel), or cross-site retargeting cookies. If we begin using any such technology in the future, we will update this Policy before doing so and, where required by law, will seek your consent first.
Section 64How to Control or Disable Cookies
Most web browsers allow you to control cookies through their settings, including blocking cookies entirely, deleting existing cookies, or being notified when a cookie is set. Because the process varies by browser, we recommend checking your browser's help documentation for specific instructions. Please note that blocking or deleting cookies, including strictly necessary cookies, may affect the functionality of our Site.
To opt out of Google Analytics specifically, see the browser add-on link in Section 62.
Section 65Do Not Track Signals
Some browsers offer a "Do Not Track" setting. Because there is currently no common industry standard for how websites should respond to Do Not Track signals, our Site does not currently respond differently to browsers with this setting enabled. We will revisit this position if an industry or legal standard for responding to Do Not Track signals becomes established.
Section 66Applicable Privacy Law
The Florida Digital Bill of Rights (Fla. Stat. § 501.701 et seq.) imposes specific consumer-rights obligations only on "controllers" that generate more than $1 billion in global gross annual revenue and meet at least one additional statutory criterion. Miami Dade Apostille does not meet this threshold and is not a "controller" as defined under that statute. We nonetheless voluntarily extend the general privacy practices and rights described in this Policy to all clients as a matter of good business practice.
Separately, the Florida Information Protection Act (Fla. Stat. § 501.171) applies to businesses of all sizes that hold personal information of Florida residents and governs our data security and breach notification obligations, as described in Sections 13 and 14.
If you are located outside Florida, additional state or national privacy laws may apply to our processing of your information depending on your location; we will comply with those laws to the extent they apply to us, including the General Data Protection Regulation described in Section 67 for clients connected to the European Union.
Section 67European Union Clients & GDPR
Miami Dade Apostille does not maintain an office or other establishment in the European Union; our Madrid office referenced elsewhere is operated by a separate business. As a result, the General Data Protection Regulation (GDPR) does not apply to us on an establishment basis under GDPR Article 3(1). However, the GDPR carries no revenue or size threshold, and it can still apply to a non-EU business like ours under Article 3(2) if we offer goods or services to individuals actually located in the European Union, or monitor their behavior. If you are located in the EU and order our Services, we apply the practices in this Section to your personal data as a matter of good business practice, and to the extent Article 3(2) applies to a given instance of processing.
Legal Basis for Processing
Where the GDPR applies, we process your personal data on one or more of the following legal bases: performance of a contract with you (to provide the apostille, notarization, translation, fingerprinting, or legalization Service you have ordered); your consent (for example, to send you optional SMS or marketing communications); compliance with a legal obligation (such as notarial recordkeeping requirements); and our legitimate interests in operating and securing our business, provided those interests are not overridden by your own rights and freedoms.
Your GDPR Rights
In addition to the privacy choices described in Section 68, if the GDPR applies to you, you have the right to:
- Access the personal data we hold about you and receive a copy of it;
- Request rectification of inaccurate or incomplete personal data;
- Request erasure of your personal data, subject to the legal and recordkeeping limitations described in Section 56;
- Request restriction of processing in certain circumstances;
- Receive your personal data in a portable, machine-readable format, where technically feasible;
- Object to processing based on our legitimate interests;
- Withdraw consent at any time where processing is based on consent, without affecting the lawfulness of processing before that withdrawal;
- Lodge a complaint with the supervisory authority in your EU member state of residence.
International Data Transfers
Because we are based in the United States, personal data you provide to us from the European Union is transferred to, and processed in, the United States, and may be further transferred to U.S.-based third-party service providers described in Section 53. We will respond to verified requests in a reasonable timeframe. We may need to verify your identity before fulfilling certain requests, particularly where the request involves sensitive documents.
Section 69Children's Privacy
Our website and Services are intended for use by individuals 18 years of age or older, consistent with the eligibility requirement in our Terms of Service. We do not knowingly collect personal information directly from children under 18. If we become aware that we have inadvertently collected personal information from a child under 18 without appropriate consent, we will take reasonable steps to delete it.

We are not part of, endorsed by, or affiliated with the U.S. Department of State, the Federal Bureau of Investigation (FBI), U.S. Citizenship and Immigration Services (USCIS), the Florida Department of State, any other state Secretary of State, or any foreign embassy or consulate. References to these agencies on our website describe the government processes we help clients navigate; they do not imply any official relationship.
Liability, Warranties & Indemnification
Section 71Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MIAMI DADE APOSTILLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITY, MISSED DEADLINES WITH A RECEIVING AUTHORITY, VISA OR IMMIGRATION CONSEQUENCES, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES OR WEBSITE.
Our total liability to you for any claim arising out of or relating to this Policy or our Services shall not exceed the total amount of fees paid by you to Miami Dade Apostille for the specific Order giving rise to the claim.
As set out in Part V, Miami Dade Apostille has no liability whatsoever for the loss, damage, or delay of any package once it has been tendered to a Carrier pursuant to a Client's election to ship rather than pick up in person; that risk rests solely with the Carrier and, as between the Client and Miami Dade Apostille, solely with the Client.
Miami Dade Apostille acts as a document processing agent and is not a law firm. We do not provide legal advice. If you require legal advice regarding your document, immigration matter, or international legal requirements, please consult a licensed attorney.
Section 72Disclaimer of Warranties
OUR WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
- Our website will be uninterrupted, error-free, or free of viruses or other harmful components;
- The results of using our Services will meet your specific requirements;
- Government agencies will accept or approve documents submitted on your behalf;
- Information on our website is complete, accurate, or current at all times.
Section 73Indemnification
You agree to indemnify, defend, and hold harmless Miami Dade Apostille, its officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of this Policy;
- Your use of our website or Services;
- Any information or document you provide to us that is false, inaccurate, fraudulent, or forged;
- Your violation of any third-party rights, including intellectual property or privacy rights;
- Your violation of any applicable law or regulation.
Dispute Resolution & Governing Law
Section 74Governing Law & Venue
This Policy and any dispute arising out of or related to Services rendered or documents shipped by Miami Dade Apostille shall be governed by the laws of the State of Florida, without regard to its conflict of laws principles. The Client agrees that any legal action arising out of or related to this Policy shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and the Client consents to the personal jurisdiction of those courts. Nothing in this Policy limits any independent legal right the Client may have directly against a Carrier under that Carrier's own terms of service.
Section 75Informal Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to this Policy or our Services, the parties agree to first attempt to resolve the dispute informally by contacting us at [email protected]. If the dispute cannot be resolved informally within 30 days, either party may pursue formal legal remedies.
Section 76Waiver of Class Action
You agree that any dispute resolution proceedings will be conducted on an individual basis only and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Miami Dade Apostille.
General Provisions
Section 77Electronic Communications & Records
The Client consents to receive communications from Miami Dade Apostille electronically, including by email, text message, and WhatsApp, regarding their Order and any related shipment. The Client agrees that electronic records of communications, order confirmations, Tracking Confirmations, and this Policy satisfy any legal requirement that such communications be in writing.
The Client further agrees that their electronic acceptance of this Policy and any electronic signature or acknowledgment provided in connection with an Order is valid and enforceable to the same extent as a handwritten signature or paper record, consistent with the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the Florida Uniform Electronic Transaction Act (UETA).
Section 78Modifications to This Policy
Miami Dade Apostille reserves the right to modify this Policy at any time at our sole discretion. When we make material changes, we will update the "Last Updated" date at the top of this document and, where appropriate, notify you via email or a prominent notice on our website.
We review and update the privacy, cookie, and biometric provisions of this Policy at least once every 12 months, and more frequently as needed to reflect changes in our practices or applicable law.
Your continued use of our website or Services after any changes to this Policy constitutes your acceptance of the revised Policy. If you do not agree to the revised Policy, you must discontinue your use of our website and Services.
Section 79Entire Agreement & Severability
This Policy, including Part VII (Privacy & Data Protection), together with any order confirmation or written agreement specific to a Client's Order, constitutes the entire agreement between you and Miami Dade Apostille regarding your use of our website and Services, and supersedes all prior agreements, understandings, and representations on the subjects it covers.
If any provision of this Policy is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified or limited to the minimum extent necessary to make it enforceable, and the remaining provisions of this Policy shall continue in full force and effect.

By submitting payment, documents, or a shipping address to Miami Dade Apostille, the Client acknowledges that they have read this Policy in full, understand its terms, and agree to be bound by it.
Section 81Termination of Service
Miami Dade Apostille may suspend or terminate a Client's access to our Services at any time, with or without cause, and without prior notice, including where we reasonably believe a Client has breached this Policy, submitted fraudulent or falsified documents, or engaged in abusive or unlawful conduct toward our staff.
A Client whose service is suspended or terminated for breach of this Policy is not entitled to a refund of fees already paid, consistent with Part IV (Refunds, Cancellations & Chargebacks), and forfeits any right to refund or other redress arising from that suspension or termination to the fullest extent permitted by applicable law.
